Services
Nova Development provides digital services which may include, but are not limited to, software, automation tools, digital products, subscriptions, APIs, bots, and custom digital solutions. We reserve the right to modify, suspend, or discontinue any part of the services at any time, with or without notice, and without liability.
Account Responsibility
If an account is required to access the services, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We are not responsible for any loss or damage resulting from unauthorized access due to your failure to secure your account.
Payments & Refunds
All payments are due in advance unless otherwise stated. Prices are listed in USD and may be changed at any time at our discretion. Unless explicitly stated otherwise in writing, all sales are final and non-refundable. Chargebacks, payment disputes, or reversals may result in immediate suspension or termination of access to the services.
Acceptable Use
You agree to use the services only for lawful purposes and in compliance with all applicable laws. You may not use the services for illegal, fraudulent, or abusive activities, attempt to reverse engineer or exploit our systems, interfere with service operation, or circumvent any security or usage restrictions. Violation of these terms may result in immediate termination without notice.
Intellectual Property
All content, software, code, branding, and materials provided by Nova Development are the intellectual property of Nova Development or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, resell, modify, or create derivative works from our services without explicit written permission.
User Content
Any content you submit in connection with the services remains your responsibility. By submitting content, you grant Nova Development a non-exclusive, royalty-free license to use such content solely for the purpose of providing and improving the services. You represent that you have all necessary rights to submit such content.
Disclaimer of Warranties
The services are provided on an "as is" and "as available" basis. We do not guarantee that the services will be uninterrupted, error-free, secure, or meet your specific needs. To the fullest extent permitted by law, Nova Development disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Nova Development shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or business, arising from or related to your use of the services. Our total liability for any claim shall not exceed the amount paid by you to us in the thirty (30) days preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Nova Development, its affiliates, and its representatives from any claims, damages, losses, or expenses arising out of your use of the services, your violation of these terms, or your violation of any applicable law or third-party rights.
Termination
We reserve the right to suspend or terminate your access to the services at any time, with or without notice, for any reason, including violation of these terms. Upon termination, your right to use the services immediately ends.
Changes & Governing Law
These Terms of Service may be updated at any time. Continued use of the services after changes are made constitutes acceptance of the revised terms. These terms are governed by and construed in accordance with the laws of Nova Development, without regard to conflict of law principles.
